How can a Rockledge Code Enforcement Board order be challenged?
A Rockledge Code Enforcement Board order can be appealed to circuit court, but the appeal must be filed within 30 days and reviews only the existing record.
Rockledge code cases start with a courtesy notice, then a certified notice of violation, and then a hearing before the Code Enforcement Board if the violation is not fixed, according to the city's Code Enforcement page. The seven member board can impose administrative fines and other non-criminal penalties.
Under section 162.11, Florida Statutes, a final administrative order of an enforcement board can be appealed to the circuit court within 30 days of the order's execution. The appeal is not a new hearing and is limited to the record created before the board.
Because the record is fixed at the board hearing, evidence and witnesses need to be presented there. Easler Law PLLC represents property owners in code enforcement disputes.
