How long does Florida law allow for a negligence or property damage lawsuit?
Florida generally allows 2 years for a negligence lawsuit, while some property claims, such as trespass or damage to personal property, carry a 4 year limit.
Section 95.11, Florida Statutes, sets a 2 year limit for an action founded on negligence. Chapter 2023-15, Laws of Florida, shortened that period from 4 years for causes of action accruing after March 24, 2023.
Some property claims carry a 4 year limit, including trespass on real property and actions for taking, detaining or injuring personal property. Construction defect claims have their own 4 year period with a 7 year outside limit. The deadline that applies depends on the type of claim.
