How is a money judgment collected in Florida?
A Florida money judgment is collected by recording liens on real and personal property and by levy and sale, while homestead and other exempt property stay protected.
A Florida money judgment becomes a lien on real property in a county once a certified copy showing the holder's address is recorded there under section 55.10, Florida Statutes. The lien lasts 10 years and can be extended.
A lien on personal property comes from filing a judgment lien certificate with the Department of State under section 55.202.
Chapter 56 allows levy and sale under execution, while the homestead and other exempt property are protected under Article X, section 4 of the Florida Constitution and Chapter 222. Easler Law PLLC's Melbourne office handles civil litigation, with virtual consults statewide.
