Titusville Ordinances 38-2026, 39-2026, and 40-2026: City Council Hearing on Diamond Oaks Annexation and Rezoning, October 27

Summary

The Titusville City Council has scheduled a public hearing on Ordinances 38-2026, 39-2026, and 40-2026 for Tuesday, October 27, 2026. The meeting starts at 6:30 p.m. at City Hall. The ordinances relate to Small Scale Comprehensive Plan Amendment (SSA) No. 3-2026, known as Diamond Oaks. Together they would annex about 5 acres at 3080 Diamond Road, change the Future Land Use designation, and rezone the property for a proposed single-family subdivision of about 14 lots. City staff recommended approval. On October 7, 2026, the Planning and Zoning Commission recommended denial by a 5-0 vote.

When and Where

The October 13, 2026 City Council agenda lists the first reading as item 10.C. That agenda states that the public hearing is set for October 27, 2026, at 6:30 p.m. in the Council Chamber at City Hall, 555 South Washington Avenue, Titusville, FL 32796.

The staff report meeting-dates table lists the public hearing as October 28, 2026. The agenda text and item cover sheet both state October 27, 2026. This post uses October 27, as stated in the agenda. As of October 15, 2026, no October 27 agenda or packet files were published on the CivicClerk portal.

What the Applications Cover

SSA No. 3-2026 covers three related requests for the same property.

  • Ordinance No. 38-2026 would annex 3080 Diamond Road, Parcel ID No. 21-35-29-00-253, into the City. The agenda calls this a legislative item. The draft cites Section 171.044, Florida Statutes, and would amend Section 7 of Chapter 63-2001, Laws of Florida. It takes effect immediately.

  • Ordinance No. 39-2026 would change the Future Land Use designation from Residential 4 (Brevard County) to Medium Density Residential on 5.0+/- acres. The agenda calls this a legislative item. The draft takes effect 31 days after adoption under Section 163.3187(5)(c), Florida Statutes.

  • Ordinance No. 40-2026 would change the zoning from Single-Family Residential RU-1-11 (Brevard County) to Single-Family High Density (R-1C) on 5.0+/- acres. The agenda calls this a quasi-judicial item. The draft takes effect at the same time as SSA No. 3-2026.

The staff report names Kevin Collins as authorized agent for Exeter 1031 Exchange Services, LLC, for property owners PR Corporate Holdings, LLC, and AKBlue Holdings, LLC. No binding concept plan was filed. Staff evaluated the requests under the maximum development potential of the proposed designations.

Property Details

The staff report describes an unplatted vacant parcel of about 5.00 acres at 3080 Diamond Road in unincorporated Brevard County, west of Old Dixie Highway, east of Singleton Avenue, and north of Dairy Road.

A traffic analysis in the packet describes the project as about 4.63 acres and proposes 14 dwelling units. The staff report, agenda summaries, and draft ordinances use 5.00+/- acres and an approximately 14-lot single-family subdivision.

Staff states that City Code Section 21-1 requires annexation before City water, sanitary sewer, or reclaimed water service may be considered. The property is contiguous to the City limits along its northwest boundary and does not appear to create a new enclave. The site is within the Area of Critical Concern, with a 40 percent maximum impervious surface coverage. Reclaimed water dry lines would be required.

Current vs Proposed Designations

Existing designations in the staff report are Residential 4 (Brevard County) Future Land Use, maximum 4 dwelling units per acre, and Single-Family Residential RU-1-11 (Brevard County) zoning. Requested designations are Medium Density Residential Future Land Use, maximum 10 dwelling units per acre, and Single-Family High Density (R-1C) zoning, maximum 6.7 dwelling units per acre. Staff states that R-1C is consistent with Medium Density Residential under the City's Future Land Use and Zoning Consistency Matrix.

Staff notes that Residential 4 could allow up to 20 units on 5.00 acres. Under R-1C, the maximum theoretical yield would be 33 units. About 14 homes on 5.00 acres would be about 2.8 units per acre. The applicant requested R-1C mainly because it allows a 65-foot minimum lot width, compared with 75 feet in R-1B. A traffic analysis in the packet states that R-1C allows 4 dwelling units per acre. The staff report figure of 6.7 dwelling units per acre is the one used here.

Staff Recommendation

The Planning Department staff report recommends approval of all three requests.

  • Annexation: annex the 5.0+/- acres at 3080 Diamond Road, Parcel I.D. 21-35-29-00-253, based on consistency with Section 171.044(1), Florida Statutes.

  • Future Land Use: approve the change from Residential 4 (Brevard County) to Medium Density Residential based on consistency with the City's Comprehensive Plan.

  • Rezoning: approve the change from RU-1-11 (Brevard County) to R-1C based on Section 34-40 of the City's Land Development Regulations.

Planning and Zoning Commission Recommendation

The October 13 agenda and cover sheet state that on October 7, 2026, the Planning and Zoning Commission recommended denial of the annexation because it is not a benefit to the City. The denial motion passed 5-0. The Commission also recommended denial of the Small Scale Map Amendment and rezoning on the same basis, again 5-0.

Meeting History

The staff report table lists Planning and Zoning on October 7, 2026, City Council first reading on October 13, 2026, and City Council public hearing on October 28, 2026. The October 13 agenda schedules the public hearing for October 27, 2026.

The October 13 agenda called for first reading as item 10.C. As of October 15, 2026, no City Council minutes or summary of action for that meeting appeared among published CivicClerk files. This post does not state the October 13 first-reading outcome. The staff report says the applicant held a community engagement meeting on July 7, 2026.

What Happens Next

Under the October 13 agenda, the public hearing is set for October 27, 2026, at 6:30 p.m. The draft Future Land Use ordinance would take effect 31 days after adoption. The draft rezoning ordinance would take effect with SSA No. 3-2026. The draft annexation ordinance would take effect immediately.

How to Take Part

Anyone who wants to be heard may attend the hearing in the Council Chamber at City Hall, 555 South Washington Avenue, Titusville, FL 32796, at 6:30 p.m. on October 27, 2026.

The agenda states that anyone who plans to appeal a Council decision may need a verbatim record of the proceedings. It also asks any physically handicapped person who wants to attend to submit a written request to the chairperson at least 48 hours before the meeting.
