Who decides a zoning variance for a Viera property?
Variance requests for Viera land go to the Brevard County Board of Adjustment, which makes the final decision after a public hearing the applicant must attend.
Brevard County defines a variance as a waiver from the Zoning Code or Sign Code due to a hardship from special conditions that the applicant did not cause. The application includes a recorded deed, a Variance Hardship Worksheet and a certified survey signed and sealed by a Florida land surveyor.
County staff review the request and send a report to the Board of Adjustment, whose members make the final decision. The applicant is required to appear before the board.
Anyone who wishes to appeal the board's decision, whether it approves or denies the request, has thirty days to do so before building permits issue.
