How does code enforcement work for Viera property?
Code violations on Viera property are handled by Brevard County, where an independent Special Magistrate hears cases and unpaid fines can become property liens.
Brevard County created a Code Enforcement Special Magistrate hearing process under Chapter 162, Florida Statutes. The magistrate is an independent hearing officer and a member of The Florida Bar practicing in the county.
When a violation is found, the magistrate assesses hearing costs, and fines follow if the violation is not corrected by the compliance date. Unpaid costs or fines become liens on the property and on other real property under the same ownership.
Buyers can look up county cases through the Code Enforcement Case Search in the county's BASS system. Open cases can be followed up with a Case Status Request Form, which takes 7 to 10 business days.
