Can a Palm Bay code enforcement lien be reduced?
Palm Bay property owners can ask the city to reduce a code violation lien by filing a Petition for Relief with the Code Compliance division.
A certified copy of an order imposing a code enforcement fine can be recorded and then becomes a lien on the land and on other property the violator owns, under section 162.09, Florida Statutes. The same section bars foreclosure of these liens on homestead property.
The City of Palm Bay's Code Compliance page offers a Petition for Relief form for owners who want a code lien reduced. The completed form goes back to Code Compliance, and lien payments and inquiries run through the city's iMS portal.
An unpaid lien can hold up a sale or refinance until it is paid or released. Easler Law PLLC reviews code liens for Palm Bay buyers and sellers as part of its real estate work.
