Who can witness a Florida health care surrogate designation?
Any two adults may witness a Florida health care surrogate designation, except the named surrogate, and at least one must not be the principal's spouse or blood relative.
Under section 765.202, Florida Statutes, the principal signs the designation in the presence of two subscribing adult witnesses. The person named as surrogate cannot act as a witness, and at least one witness must be neither the principal's spouse nor a blood relative.
The document may name an alternate surrogate if it does so explicitly. Unless it states a time of termination, the designation stays in effect until the principal revokes it.
