On what grounds can a will be challenged in Florida, and how long is there to object?
A Florida will can be challenged for fraud, duress, mistake, undue influence, improper signing or lack of sound mind, within 3 months after service of the notice of administration.
Under section 732.5165, Florida Statutes, a will, or any part of it, is void if its signing was procured by fraud, duress, mistake or undue influence. A will can also be challenged for improper signing or witnessing under section 732.502, or because the testator was not of sound mind as section 732.501 requires.
An interested person served with a notice of administration has 3 months after service to object under section 733.212. That period can be extended only when the personal representative misstated the deadline.
