What flood disclosure must a Florida home seller give a buyer?
A Florida home seller must give the buyer a flood disclosure at or before signing the contract, covering known flood damage, past flood insurance claims and flood aid received.
Since October 1, 2024, section 689.302, Florida Statutes, has required a seller of residential real property to give the buyer a flood disclosure at or before the time the sales contract is signed.
The current form states whether the seller has knowledge of any flooding that damaged the property during the seller's ownership, whether the seller has filed a flood insurance claim, including with the National Flood Insurance Program, and whether the seller has received assistance for flood damage, such as help from FEMA.
It also states that homeowners' insurance policies do not cover flood damage.
