Can a Florida real estate closing be done remotely when a buyer or seller lives out of state?
Yes. A Florida online notary located in Florida may notarize for a signer in another state, though lenders and title insurers set their own remote closing rules.
Florida's notary law allows it. Under sections 117.209 and 117.265, Florida Statutes, a Florida online notary who is physically in Florida may notarize for a signer located outside the state, and the notarization is treated as performed in Florida and governed by Florida law.
The notary verifies identity and records the audio video session. Witnesses may also appear remotely under section 117.285.
In practice, lenders and title insurance underwriters set their own rules for remote closings, so the parties confirm those requirements before the closing is scheduled.
