What is a designation of preneed guardian in Florida?
Florida lets a competent adult choose a future guardian in advance, and the chosen person is presumed entitled to serve unless found unqualified.
A designation of preneed guardian is a written declaration in which a competent adult names the person to serve as guardian if the adult becomes incapacitated.
Under section 744.3045, Florida Statutes, it must be signed in the presence of two attesting witnesses who are present at the same time, and it may be filed with the clerk of court. The named person is presumed entitled to serve unless found unqualified.
