What is a pour over will in Florida?
A pour over will moves property left outside a living trust into that trust at death, so the trust's terms decide who receives it.
A pour over will leaves property to the trustee of a trust, usually a revocable living trust that was signed before or at the same time as the will. Section 732.513, Florida Statutes, allows this kind of gift if the will identifies the trust.
The gift stays valid even when the trust is revocable or is amended later, and the property becomes part of the trust and is handled under its terms. If the trust is entirely revoked before death, the gift fails.
