How long do creditors have to file claims against a Florida estate?
Creditors generally have 3 months after the notice to creditors is first published, or 30 days after being served, and claims are generally barred 2 years after death.
After a Florida probate opens, the personal representative publishes a notice to creditors once a week for 2 consecutive weeks under section 733.2121, Florida Statutes and serves the notice on creditors who are reasonably ascertainable.
Under section 733.702, a claim must be filed by the later of 3 months after first publication or, for a creditor who was served, 30 days after service.
Section 733.710 sets an outside limit. Two years after the date of death, claims are generally barred whether or not probate was ever opened.
