When does oceanfront work in Cocoa Beach need a state CCCL permit?
Construction seaward of the Coastal Construction Control Line on Cocoa Beach's oceanfront generally needs a permit from the Florida DEP unless an exemption applies.
The Coastal Construction Control Line marks the part of the beach and dune system subject to severe changes in a 100 year storm. Unless exempt, construction and excavation seaward of the line need a permit from the Florida Department of Environmental Protection.
The line is not a setback, so building seaward of it is possible with special siting and design. DEP's CCCL guidance says maintenance, repairs and changes to existing structures are generally exempt if they do not involve the foundation.
Cocoa Beach code requires all state permits to be approved before the city issues a building permit, according to its building permit procedures. Section 161.053, Florida Statutes, governs the line.
