What happens to an original will after a Brevard County resident dies?
Florida law requires whoever holds the original will to deposit it with the Brevard County Clerk of Court within 10 days after learning of the death.
Under section 732.901, Florida Statutes, the person holding an original will must deposit it with the clerk of the court where the estate will be administered within 10 days after learning of the death. For a Melbourne resident, that is the Brevard County Clerk of Court.
The custodian must also give the clerk the date of death or the last four digits of the testator's Social Security number. The clerk keeps the original will in its original form for at least 20 years.
